Determining the Amount of Narcotics and Psychotropic Substances Presumed to Be in Possession for Consumption

B.E. 2567 (2024)

 

By virtue of Section 24, paragraph two, of the Narcotics Law Act, B.E. 2564, and Section 107, paragraph two, of the Narcotics Code, the Minister of Public Health issues the following ministerial regulations:

 

Clause 1. Definitions used in these ministerial regulations:

 

“Usage unit” means tablets, packets, bottles, or other units that are normally made for one-time use.

 

Clause 2. Possession of narcotics in Category 1, Category 2, or Category 5, or psychotropic substances in Category 1 or Category 2, in small quantities as specified below, is presumed to be for consumption:

 

1.Narcotics in Category 1:

a. Amphetamine (amphetaminc or amfetamine) in quantities not exceeding five dosage units or with a net weight not exceeding five hundred milligrams.

b. N-ethyl MDA or MDE (N-ethyl MDA or MDE) in quantities not exceeding five usage units or with a net weight not exceeding one thousand two hundred and fifty milligrams.

c. Heroin (heroin or diacetylmorphine) with a net weight not exceeding three hundred milligrams.

d. Dextrolysermind ((+)-Lysergide) or LSD (LSD) or LSD-25 (LSD 25) in quantities not exceeding five dosage units or with a net weight not exceeding one hundred milligrams.

e. Methamphetamine (methamphetamine or metamfetamine) in quantities not exceeding five usage units or with a net weight not exceeding five hundred milligrams, or in the case of flakes, powders, or crystals, with a net weight not exceeding one hundred milligrams.

f. Methylenedioxyamphetamine (methylenedioxyamphetamine or Lonamfetamine or MDA) in quantities not exceeding five usage units or with a net weight not exceeding one thousand two hundred and fifty milligrams.

2. Narcotics in Category 2:

a. Cocaine with a net weight not exceeding two hundred milligrams.

b. Morphine with a net weight not exceeding five thousand milligrams.

3. Narcotics in Category 5:

a. Opium plants or tins of the same genus that produce opium or opium alkaloids with a net weight not exceeding fifteen thousand milligrams.

b. Buffalo dung mushrooms or buffalo dung mushroom plants or those with other names in the same genus that produce psilocybin or psilocin with a net weight not exceeding one hundred and thirty-five thousand milligrams.

c. Tetrahydrocannabinol (THC) that is an extract from every part of the cannabis or hemp plant that is a Category 5 narcotic, with a net weight not exceeding thirty thousand milligrams, or in the case of liquid, with a net volume not exceeding thirty milliliters.

4. Psychotropic substances in Category 1:

a. Fluasprazolam (flualprazolam) in quantities not exceeding five dosage units or with a net weight not exceeding six hundred and fifty milligrams.

b. Phenazepam in quantities not exceeding ten dosage units or with a net weight not exceeding one thousand six hundred and forty milligrams.

5. Psychotropic substances in Category 2:

a. Alprazolam in quantities not exceeding ten dosage units or with a net weight not exceeding one thousand three hundred milligrams.

b. Ketamine, in the case of liquid, with a net volume not exceeding ten milliliters or with a net weight not exceeding ten thousand milligrams, or in the case of flakes, powders, or crystals, with a net weight not exceeding five hundred milligrams.

c. Midazolam in quantities not exceeding ten dosage units or with a net weight not exceeding two thousand eighty milligrams.

d. Nimetazepam in quantities not exceeding ten dosage units or with a net weight not exceeding one thousand eight hundred and ninety milligrams.

e. Nitrazepam in quantities not exceeding ten dosage units or with a net weight not exceeding five thousand five hundred sixty milligrams.

f. Phentermine in quantities not exceeding ten dosage units or with a net weight not exceeding three thousand two hundred milligrams.

Note: The reason for promulgating this Ministerial Regulation is that Section 107, paragraph two, of the Narcotics Code provides for the Minister of Public Health to issue a Ministerial Regulation to determine the quantity of narcotics in Category 1, Category 2, or Category 5, or psychotropic substances in Category 1 or Category 2, in a small amount which gives the presumption that it is in possession for consumption. Therefore, it is necessary to issue this ministerial regulation.
