Promulgating The Criminal Procedure Code

Being the 2nd year of the present reign.

Whereas the House of Representatives voted that it was appropriate to promulgate a legal code criminal procedure

Therefore there was a royal command. An Act shall be enacted with advice and consent. of the House of Representatives as follows:

Section 1 This Act shall be called the “Act to Adopt the Criminal Procedure Code, B.E. 2477”.

Section 2 This Act shall come into effect from the date of its publication in the Royal Gazette onwards.

Section 3 The Criminal Procedure Code as enacted at the end shall apply this act From 1 October 1935 onwards

All courts and officials who prosecute criminal cases throughout the Kingdom shall act following the provisions of this Code except for the court which has special procedures for consideration.

All the cases which are pending in the court before the effective date of this Code shall be governed by law which is in use before the date of enforcement of this Code until the case is final.

Section 4 Subject to the provisions of Section 3 from the date of entry into force of this Criminal Procedure Code. Sections 14, 16, and 87 to 96 of the Penal Code, the Penalty Procedure Act, R.S. 115, and all other laws, regulations, and rules that this code prescribes or are inconsistent with its provision, shall be repealed.

Section 5 The President of the Supreme Court, the Prime Minister, the Minister of Interior, and the Minister of Justice. Acting following this Act.

The President of the Supreme Court has the power to issue regulations and the Prime Minister, Minister of Education Ministry of Interior and the Minister of Justice have the power to issue ministerial regulations to organize the Carrying out of duties to ensure that criminal proceedings are carried out smoothly in areas related to their authority and responsibilities.

The regulations or ministerial regulations, Once announced in the Royal Gazette, shall come into force.
