Kinky Sex and the Law: BDSM Liability Risks
The novel and movie “Fifty Shades of Grey” may be making BDSM part of mainstream sex culture, but adults should be wary of the potential liability risks kinky sex poses especially with regard to consent, reports Tamara Tabo with Above the Law.
According to Tabo, the liability risks involving consent and BDSM include the authenticity, the legal validity, and the ways to prove consent.
BDSM sexual encounters pose greater risks and challenges in these three areas of consent because of its overtly aggressive nature commonly coupled with role-playing.
Tabo explains that even if two consenting adults agree to a BDSM arrangement – not dissimilar from the one proposed between fictional characters Christian Grey and Anastasia Steele – the law may not even recognize their consent as valid.
And beyond merely establishing validity, Tabo goes on to describe how the “greatest legal concern surrounding BDSM sex” is how to prove either consent or withdrawal of consent in behavior that is typically committed in private, indeed often times in secret, between two people.
