An increasing amount of pet owners are now considering signing pet prenuptial agreements to decide who keeps the pets in the event of a break up or a divorce reports The Telegraph.
The article continues that 1/5 of couples splitting up report they find deciding who keeps any animals are stressful as who receives custody of the children.

The issue has come to light as recently two high profile couples have gone to court to decide who keeps their pets – Nicole Appleton and Liam Gallagher and Charles Sataachi and Nigella Lawson.
Thailand divorce lawyer, Jiraporn Thongpong comments, “this raises a really interesting point of law, and it is unusual it has not been reported on before. Pets are treated by the courts as “property” which means they can form part of a prenuptial agreement, unlike children. In my experience more and more couples are now entering into prenuptial agreements”.

For me, I don’t see pets as ‘property’, but alike them to children when finalizing a divorce settlement. Pets also need to be cared for and looked after properly the same as children do.
pets are members of the family, not a material assets. Courts needs to remember to keep the best interest of the pet in mind when deciding who is the best person to take custody of the animal.
