The bill was pushed by the state’s LGBTQ community
Washington D.C finally passed a bill that legalizes surrogacy replacing the state’s old law which subjected parties in surrogacy agreements to a fine of up to $10,000 and a one-year prison sentence.
Washington Blade reports, “After four years in the making, a bill ending D.C.’s longstanding criminalization of surrogacy parenting and establishing a legal framework for surrogacy agreements became law on April 7 upon completion of a required congressional review.”
The bill was advocated by LGBT rights organizations whose ability to have children was impeded by the state’s antiquated surrogacy laws.
The new law provides guidelines for intending parents and surrogates and provides detailed measures on how the intending parents should establish parental rights.
Several states in the U.S have laws permitting surrogacy. In Thailand, commercial surrogacy is illegal. However, Thai surrogacy laws allow married Thai residents to use the services of a surrogate. The law does not include same-sex couples.
