US Federal Court Overturns Block On Indefinite NDAA Detention

The Second Circuit court has overturned a temporary injunction which had stopped the indefinite detention provision of the National Defense Authorization Act (NDAA). The result of this decision means both Americans and foreigners can now again be kidnapped and held without trial if it is believed they are aiding or supporting terrorism.

President Obama has been quick to say he will never abuse this power, but a group of highly outspoken journalists disagree and thus lodged a federal law suit last year, challenging the constitutionality of Section 1021, the particular law that provides for such broad power. Initially they were successful, but President Obama appealed, and yesterday was successful.

Once again the White House has the power to detain those they wish and hide behind the terrorism veil.
