UK Judge Denies Police Report Access to Koh Tao Murder Suspects

A British judge has ruled that the two Myanmar suspects in the murder of two British tourists last year, should be prohibited from seeing a confidential British police report, writes The Nation.

If convicted, Wai Phyo and Zaw Lin may face the death penalty.

Hannah Witheridge, 23, and David Miller, 24, were murdered last year on a beach on the island of Koh Tao, a popular tourist destination. Both had suffered head wounds and Witheridge had been raped.

Criminal lawyers in Thailand Chaninat and Leeds are experts at handling criminal law cases, for both Thai nationals and foreigners.

After a shaky start to investigations following the incident, it was agreed that Britain’s Metropolitan Police would send a team to observe, but not interfere with, the Thai police investigation.

The Thai police agreed to this under the condition that the British team’s report would only be shared with the families of the victims.

However, the two murder suspects applied to the court to have access to the report, claiming it might assist their defense team.

The British judge said:

“In short I have concluded that there is nothing in the police report which is exculpatory, i.e. would be of material assistance to the claimants in the trial.”
