German Transsexual Woman Fights for Right to be Called Mother

Germany’s Federal Court has denied the appeal for a transsexual woman to registered as her child’s mother after using her sperm to fertilize her partners egg. The Court states that under ancestry law, the legal status of the parent reflects her former sex when the sperm was used to procreate.

The woman had changed her sex in 2012 and three years later used her frozen sperm to create the child. The registry office had initially rejected her request to be legally listed as the mother and later a lower court also had rejected the same request.

Germany’s top court remains in the position that no transsexual person’s basic rights were violated due to the ancestry law.
