Sweden May Introduce Sharia Divorce Law

Sweden may soon include an element of Sharia law into its Supreme Court rulings on prenuptial agreements, reports Sputnik News.

Lawyer Fatemeh Sanaei Nasab of the Iranian Ministry of Justice told Sputnik that it was likely the Supreme Court would allow Sharia law to apply to prenuptial agreements.

This follows at least two cases related to whether Iranian legislation is valid in the country.

One such case involved an Iranian married couple who moved to Sweden. The district court ruled that in accordance with Swedish law, the husband would not be required to pay the wife the Mahr.

The Mahr is a mandatory payment from the bridegroom to the bride. After marriage the payment legally becomes her property. The Quran and Hadith mention the requirement of a Mahr several times.

A Mahr is not to be confused with a gift, it is a religious requirement under Islamic law. This occasionally comes in the form of an IOU.

It is frequently confused with dowry, which differs in that a dowry is what the woman brings to the marriage – in the form of money, jewelry or property from her family.

Nasab says:

“I think that as the issue of paying a mahr is related to the Iranian couples, it is quite logical that the court deemed it necessary to rely on Iran’s legislative norms.”
