Sparky’s Sentimental Value? Ask the Texas Supreme Court

After a Texas family’s pet was accidentally euthanized, the family took the case to court to sue for emotional damage. Three years later, the case is now in Texas’ Supreme Court, where the Court must decide how much that pet’s sentimental value is exactly worth.

Jeremy and Kathryn Medlen’s family dog, Avery, escaped from the yard during a thunderstorm and wound up in the local Animal Control shelter. When the family went to pick him up, they found out he was euthanized the day before. While the cage was marked “hold for owner,” a shelter worker accidentally tagged him to be euthanized.

Texas has a “sentimental value” law that allows the family to sue even if the object destroyed has no market value. Question is, does the “sentimental value” law apply to pooches, and if so, what implications does that have for insurance companies?
