Advocates for legalizing prostitution have taken their fight to San Francisco’s Appeals Court, SF Gate reports.
The case was brought by three former sex workers along with the Erotic Service Providers Legal, Educational and Research Project. They claim that the state’s laws against on prostitution, which have been in place since 1872, violate people’s right to engage in consensual sex.
Last year, Judge Jeffrey White rejected their cases, saying the law acted as a deterrent for violence against women and human trafficking. However, a panel of three judges in San Francisco’s Court of Appeals suggested on Thursday that the law may need to be brought up to modern standards.

Carlos Bea, one of the most conservative judges in the court, asked “why should it be illegal to sell something that is legal to give away?” Another Judge, Conseulo Callahan, mentioned that sex work has historically been “subject to moral disapproval”.
