Current legislation used to investigate rape cases with a minor under the age of 15 is that the child must prove how they were coerced into the sexual activity. A new law in France will now require the adult involved to prove consent.
Ms. Schiappa, the gender-equality Minister, says the change in law is a part of a group of amendments to crackdown on sexual aggression. The change in law also follows a case with a 29 year old who walked away from rape charges when he had sex with an 11 year old. The court could not prove that the 11 year old was coerced into the situation.
The debate whether the age of consent should be 13 or 15 has preceded the planned amendment. Legislators have settled on the age of consent at 15.
