A loophole in the law in North Carolina means that a man has the right to continue sex even if a woman revokes consent, according to Vice.
A 1979 state Supreme Court ruling that has never been overturned states that consent can’t be withdrawn after penetration has already occurred. As a result, a man can’t be charged with rape under these circumstances.
Aaliyah Palmer, 19, allegedly consented to sex with a man at a party but changed her mind after he became violent. She says the loophole is “really stupid”. “If I tell you ‘no’ and you keep going, that’s rape”, she added.

State Senator Jeff Jackson agrees, and filed a bill to change this law in March. The bill, titled SB 553, reads “a person may withdraw consent to engage in vaginal intercourse in the middle of the intercourse, even if the actual penetration is accomplished with consent and even if there is only one act of vaginal intercourse”. The bill is currently awaiting review by the Senate’s Rules Committee.
