Potential Significant Reform in Muslim Family Law

India is the latest country in the development of outlawing the Muslim tradition of reciting “Talaq” three times for an instant divorce. VOA News reports that the government introduced a bill to make “triple talaq” a non-bailable offence with up to three years in jail. The bill was easily passed in the lower house of parliament where the government has majority.

However, the challenge came when the bill moved to upper house of parliament where it was blocked by opposition parties. Their argument being that the clause where an offender should continue to support his wife “is meaningless since he cannot do so from jail”. Bill enthusiasts argue that the tough provisions will act as a hindrance for Muslim men who resort to instant divorce.

Parents who require legal assistance for child custody in Bangkok or other areas in Thailand should contact family law experts.

In terms of family law for Indians, it us under religious considerations to govern civil issues such as divorce and property rights. Where Hindus and Christians have laws for these aspects, the Muslim community doesn’t. This is why thousands of Muslim women are being forced out of homes with little financial support because of “triple talaq”.
