Ohio Upholds HIV Disclosure Law

According to The Columbus Dispatch, the Ohio Supreme Court has ruled that it’s a crime for HIV-positive individuals not to disclose their HIV status before having sex with a partner.

The court upheld the state’s disclosure law by a majority decision this week, ruling that it did not violate freedom of speech.

Advocates for HIV patients protested the decision, saying it doesn’t take into consideration “the scientific advancements that have transformed the disease and those who are diagnosed”.

Elizabeth Bonham, staff attorney at the American Civil Liberties Union of Ohio, said that the state “cannot allow the fears and confusion of the past to guide our current policy on HIV.”

The ruling could be appealed to the US Supreme Court.
