Now Illegal for Drivers to Use Phone at Red Light

A new ruling has announced that it is illegal for drivers to use their mobile phones while stopped at a red light, reports the Bangkok Post.

Former Supreme Court judge Chuchart Srisaeng, posted the news on his Facebook page on Sunday. He said the Council of State came to the decision after being asked by the Royal Thai Police Office, who were unsure whether it violated Section 43 of the Land Traffic Act, which prohibits drivers from using their phones whilst driving, without a hands-free device.

There was uncertainty as to whether it posed a safety risk as the driver is not actually ‘driving’ whilst at a red traffic light. However it was decided that although the vehicle is at a standstill, the driver is still responsible for the safety of the car, and must be vigilant for when the light turns green.

A year ago the same issue was highlighted but at that time it was deemed fine for drivers to talk while the car is not moving.

Talking on a hands free device is still fine.
