The Thai government has signed a memorandum of understanding with a series of different labor groups, including two International Labor Organizations which could lead to major changes being implemented into Thai employment law, guaranteeing workers, including migrants, certain legal rights and conditions reports The Nation.
Marking the “World Day of Decent Work” on October 7, a group of labor reps gathered outside Government House and submitted a request to Deputy PM Pracha Promnog, asking the government to ratify ILO Conventions 87 and 98.
ILO Convention 87 allows laborers or employees to group legally in order to make demands for better conditions and welfare benefits, without previous consent from authorities. People have the right to assemble regardless of their political beliefs, race, skin color or nationality.
Convention 98 obliges state authorities to protect the rights of striking workers from employer discrimination, whilst making certain that all workers are free to join unions. Authorities must also guarantee there is no intrusion between bodies of employers and employees, and that all laws and measures on protection of workers’ rights are always actionable
Thailand has not ratified either of these conventions, even though it is a founding member of the ILO. The signing of a memorandum however is only a first step to an amendment of law in Thailand and the requirements of the memorandum have not yet been approved by the Thai Government.
Presently Thailand employment laws regulate employment and working conditions such as maximum work hours, working days, holidays, overtime, maternity leave, employee welfare, social security, termination of employees, occupational health and safety, grievances, sick leave, minimum wage and severance pay.
