Marriage and Divorce In England: The Increased Use Of Prenuptial Agreements

If you live in England and are soon to be married you may wish to give consideration to signing a UK prenuptial agreement.

 Many people in England don’t give much them thought, believing them not to be worth the paper they are written on. Indeed, prenuptial agreements have historically not been considered legally valid until a landmark case in 2010 which showed that not to be the case

Whilst it presently appears that prenuptial agreements will not become legally binding until 2014, they are now in any event a factor that may be taken into account by Courts when determining the final issues relating to a divorce settlement. Short childless marriages for instance, will entice English Courts to give greater weight to a Prenuptial Agreement, then a longer marriage where circumstances are very different to when the prenup was drafted.

If you have acquired considerable assets and wish to preserve and protect them as much as possible from future litigation, you would be strongly advised to take legal advice about signing a prenup.

There is of course endless discussion about whether prenuptials are a sensible and recommended approach of protecting yourself ahead of marriage, or whether they remove any romance from the happy occasion by contemplating divorce before the vows are even made.

In Thailand law, a prenuptial agreement is null and void unless it is officially registered in Thailand before the marriage. In the UK and other western countries, it is generally a private agreement between parties and is not registered with the government.

However putting the debate to one side, no one can deny there is a purpose for prenuptial agreements and more and more couples are now entering into them. They are something all couples should at least give consideration to, before saying I do.
