US District Court Rejects Lawsuit Disputing Marijuana Classification

Judge Hellerstein from the US District Court for the Southern District of New York has allowed the government to dismiss a lawsuit that would change the classification of Marijuana under the Controlled Substances Act.

The lawsuit was dismissed as the plaintiff had not pursued “all administrative remedies” before approaching the court for assistance. The plaintiff’s argument was that marijuana’s Sechedule 1 classification is short of any rational foundation and cannot be pursued.

The court states that because the plaintiff has presented the case as a constitutional issue, they want amendments that would be accessible in an administrative setting.
