Is a Foreign Divorce Valid in the U.S.?

by Admin on February 5, 2013

Is a divorce filed in a country outside of the United States valid within the U.S.?

That’s the question a Nigerian is asking on The Republican.

In a word, yes. The Republican writes,  “Foreign divorces are given full faith and credit by the U.S. Citizenship and Immigration Services as long as the divorce proceedings were conducted according to the laws of the jurisdiction or country in which the divorce took place, and there is no issue with authentication.”

It’s simply a matter of authenticating the divorce documents. If the divorce filings were issued by the appropriate foreign governing body, then obtaining another divorce in the United States is not necessary.

Similarly, Thailand divorce cases that involve foreign nationals are honored in the United States, so long as the correct documents are issued. It’s beneficial to consult a Thailand divorce lawyer to make sure you have the appropriate paperwork.
