Ireland Amends Sex Law for the Intellectually Challenged

Previous law made it illegal to engage in sexual activity with anyone who suffered from an intellectual disability

Ireland amended a sex law that previously made it illegal for people to engage in sexual relations with someone who has an intellectual disability.

The new rule will instead consider whether a person who has an intellectual disability has the capacity to consent to a sexual relationship rather than banning it outright.

The law was made with the assumption that individuals with intellectual disabilities could not consent to a sexual relationship. The law was updated to include a “protected person” category which states that only sex with someone who does not understand the activity is illegal.

Kathleen O’Meara, director of communications of the Rehab Group said to Breaking News, “While, it is the case that this new law could have gone further to create a more disability-neutral law, we believe this change in the law will provide greater opportunities to people with intellectual disabilities to assert their human right to marry and to found a family.”

“It will also open access to essential sex education and sexual and reproductive health services for people with intellectual disabilities just like everyone else.”
