Indian Court Rules in Favor of Surrogate

The surrogate had pleaded that the biological father was not of good character

A High Court in Bombay ruled in favor of a surrogate over the biological father of a three year old child after the surrogate claimed that the man was “not of good character”.

The man, an Iranian national, filed a petition with the court claiming that his daughter’s surrogate mother fled with the child despite a family court order giving him sole custody.

The surrogate has requested the court to allow the child to live with her stating that the biological father was not a good man.

The court stated, “We are of the considered view that it would be in the interest of the child to keep her in a good in-house school or institution where all her needs including health, education, etc, will be taken care of and where both parents can have the right to visit the child.”

The child and the surrogate are currently housed in an NGO Shanti Sadan Mahila Vastigruha pending further hearing.

Surrogacy has been legal in India since 2007, but lawmakers are working on having commercial surrogacy abolished altogether due to exploitation of surrogate mothers who usually hail from very poor backgrounds.

In Thailand, commercial surrogacy was banned in 2015. Surrogacy laws in Thailand allow only Thai residents who are married and of the opposite sex to use the services of a surrogate.
