House Sellers: No Need to Reveal Murder History

House sellers in Pennsylvania are not required to tell potential buyers about past events that happened in the house that have “psychological stigmas” such as murders or suicides, reports Courthouse News Service.

The unanimous ruling comes from the Pennsylvania Supreme Court after Janet Milliken sued Kathleen and Joseph Jacono for selling her their house in 2007 without disclosing a murder-suicide that occurred in the house in 2006.

Milliken sued for fraud, negligent misrepresentation and violations of state consumer protection laws, according to Courthouse News. The trial court ruled in favor of the Jaconos and the Supreme Court later agreed with the initial ruling.

In the court opinion, Justice J. Michael Eakin stated, “The occurrence of a tragic event inside a house does not affect the quality of the real estate, which is what seller disclosure duties are intended to address.”
