High Court Judgement: Parenting Time Can’t Be Bargained Away In Divorce

The Indiana Supreme Court yesterday made it clear that child support payments cannot be reduced in exchange for giving up contact time. NWI Times reports the state’s high court turned down a 2006 Jackson County dissolution decree requiring a father give up parenting time with his child in exchange for the mother’s taking on sole financial responsibility for the child.

The Court was quite frankly shocked that any agreement could have been reached in the first place. It said the child’s best interest was paramount and only in rare cases would that include depriving a father or mother of contact with the child.

Legal issues surrounding child custody following the break down of a relationship can often be the hardest for the couple to agree on. Of course child custody disputes between parents can arise in the course of a divorce case, or between unmarried parents. Child custody cases are handled in Thailand Family courts.  Thailand child custody law states that both parents of a child have full custodial rights. Similarly to the Indiana Supreme Court, the main consideration used by the courts in Thailand when determining custody is what is in the best interest of the child.
