Discrimination Against Transgender People in Retirement Homes Criminalized

Last week, California Gov. Jerry Brown passed a new law to protect transgender individuals in hospitals, retirement homes and assisted living facilities.

Under this law, care workers must let patients use the bathroom that matches their gender identity, and are prohibited from discriminating against them in any way. This includes “willfully and repeatedly” addressing them by the incorrect gender pronouns when they are “clearly informed of their preferred name or pronouns”.

“It shall be unlawful for a long-term care facility or facility staff to take any of the following actions wholly or partially on the basis of a person’s actual or perceived sexual orientation, gender identity, gender expression, or human immunodeficiency virus (HIV) status”, the bill states.

Violators could face punishments of up to a year in jail and/or a fine not exceeding $1,000.

State Senator Scott Weiner said the law creates “new rights” for transgender people, but critics say it’s a violation of freedom of speech.
