Germany Legalizes Third Gender for Intersex Babies

According to Jurist, Germany has ruled that a third gender option must be available on birth certificates.

The decision came in a landmark case brought by an intersex individual. Due to lack of non-binary options, they were required either to be registered at birth as male or female, or to have their gender listed as ‘missing information’.

They felt that “missing information” wasn’t a sufficient representation of their identity, as a chromosomal analysis had showed that could not be defined as distinctly male or female.

The court ruled that Article 1, Article 2, and Article 3 of Germany’s Federal Constitution, which requires intersex people to register as a binary gender at birth, is unconstitutional on the grounds of violating fundamental rights.

As a result, new legislation will be implemented before the end of the year.
