The first Jewish Israeli male couple to marry has now filed for divorce in a Tel Aviv rabbinical court that never recognized the marriage.
The couple was married in Canada after living together for more than a decade. They were also the first same-sex male couple in Israel to have their legal right of adoption recognized. One of the men wants to marry another man in another country but cannot until he is divorced.
Under Israeli law, the rabbinical court is the only body authorized to annul the marriage of Jewish citizens in Israel. The Interior Ministry will not dissolve the marriage without an order from the rabbinical court and only Canadian citizens can be divorced in Canada. A separation agreement has been approved.
The couple filed a lawsuit with Israel’s Supreme Court that forced the Interior Ministry to recognize the marriage abroad.
According to Thailand divorce attorneys, in Thailand same-sex marriages are not legal and the situation of the Israeli couple has not yet been addressed in any similar Thai Supreme Court. It is therefore uncertain whether a Thai court would allow the divorce of a gay couple who was legally married overseas.
