Defense lawyers are arguing that FBI agents planted hidden recording devices outside a San Francisco courthouse during a real estate court case.
As CBS news reports, the agents were investigating five real estate agents who are accused of fraud and bid rigging.
The agents allegedly captured over 200 hours of conversations, in areas usually deemed to be discreet for those wanting to discuss sensitive matters.
The defense attorneys say the government did not get a court order for these recordings, which are therefore unlawful under the Fourth Amendment.
Prosecutors argue that the agents had the right to use the devices, and had received the green light from the Department of Justice.
