Divorce Lawyers Report Increase in Postnuptial Agreements

Divorce attorneys have revealed an increase in married couples adopting postnuptial agreements, according to PR Week.

A postnuptial agreement varies to the more commonly understood prenuptial agreement, as it involves voluntary legal contracts signed by couples who are already married, rather than before.

In a recent survey, 50% of the members of the American Academy of Matrimonial Lawyer (AAML), cited an increase. 48% reported no change and 2% reported a decrease.

James McLaren, president of the American Academy of Matrimonial Lawyers, said:

“A postnuptial agreement is usually produced from some kind of serious strain or emotional fracture that directly impacts the marriage. It can represent a way for the spouses to move forward with a shared understanding about the ways in which certain subjects would be addressed in the event of a divorce […] The top items covered in a postnup are ones that typically cause the most stress and concern if a marriage enters a place of real uncertainty.”
