Court Rules Removal of Condom without Consent is Rape

This is a first of its kind ruling in Switzerland

In a first of its kind ruling, a Swiss court has found a man guilty of rape after he had removed the condom without the woman’s knowledge during what had been up to that point, consensual sex.

According to a report by The Guardian, neither the man nor the victim have been named and the only detail that has been released about the incident is that the 47 year old French man and the Swiss local had met on Tinder.

The Swiss Federal Supreme Court decided that having sex without a condom constituted rape if the use of one was expected. The man was handed a suspended 12 month sentence.

According to Independent, “The victim’s lawyer has described the conviction as “a first for Switzerland”.”
