Chubby Noodle filed a trademark suit against Fat Noodle for having a “confusingly similar” name and logo, reports Inside Scoop SF.
Chubby Noodle was established in San Francisco in 2011 and opened a second location in 2014. Meanwhile, Fat Noodle is being touted as one of San Francisco’s most anticipated 2015 restaurant openings.

Chubby Noodle claims in the suit that both restaurants’ logos “incorporate a stylized bowl with noodles in the bowl,” as well as unfair competition and trafficking in a domain name confusingly similar to a trademark, according to Inside Scoop.
Lawyers for Fat Noodle said the allegations were “without merit,” claiming that Fat Noodle was conceived back in 2008 and that a Fat Noodle trademark was filed in October 2012.

You can get common law trademark protection simply by using your mark in commerce. You still get the protection against someone setting up shop next door to your business, selling the same thing, calling themselves by the same name.
