Canada to Amend Sexual Assault Law

Consent and consciousness go hand in hand

Canada is set to revise its laws on sexual assault by clarifying what consent means and introducing “rape shield laws” to better protect victims in court.

The law will specify that consent cannot be given if one of the parties is unconscious.

“I am hopeful that the proposed changes to the sexual assault provisions will go a long way towards ensuring that complainants are treated with the compassion, dignity and respect they deserve,” BBC quotes Justice Minister Jody Wilson-Raybould as saying.

According to BBC, the bill is expected to pass the liberal majority Parliament.

Canada’s current “rape shield laws” do not allow the courts to use a complainant’s sexual history or medical records as evidence to prove consent to sex or to test her credibility. The changes proposed on Tuesday would expand these laws to include sexual texts, emails, pictures and videos.

The Criminal Code of Thailand recognizes only the age of consent. Its always advisable to talk to a criminal lawyer in Thailand to ascertain whether or not one can proceed with a sexual assault claim.
