Bribery And Corruption In Thailand Following Arrests In China

British Drug Company, GlaxoSmithKline is under investigation for claims its employees bribed doctors in China. Police allege the company’s employees used travel agencies and consulting firms to hide a total of 3 billion yuan (£320 million or 15,210,356,783 baht), enabling them to avoid  GlaxoSmithKline’s internal anti-bribery controls.

Four employees, including a vice president had been detained. This does not include the finance director, but that director has been barred from leaving the country. The president of its Asia-Pacific branch admitted executives “appear” to have broken the law.

Corruption is of course a word all too commonly used in reference with Thailand Criminal Law however several pieces of  legislation were passed by the Thai Government to tackle the growing need for eliminating corruption. Corruption under the Thai Criminal Code includes offenses relating to public administration such as bribery, solicitation and acceptance of gifts, abuse of political position for personal benefit. It also includes malfeasance and vote buying.

However there are also international laws as well as national laws. Take for example, the Foreign Corrupt Practices Act 1977 helps regulate transparency and bribery of foreign officials. The Act is also applicable to any act by U.S. businesses, foreign corporations trading securities in the United States, American nationals, citizens, and residents acting in furtherance of a foreign corrupt practice whether or not they are physically present in the United States.
