The Supreme Court of Arizona denied the appeal for the death sentence punishment for first degree murderer, Abel Hidaglo. Hidaglo’s argument was that the trial court had denied him an evidentiary hearing making his sentencing “unconstitutional”.
He further argues that his case violates his eighth amendment and it gives almost all those guilty of first degree murder to be eligible for the death penalty statute. In 2017, Hidaglo took his case to the US Supreme court where Justice Stephen Bryer turned the case away. He states that there was not enough evidence as the “evidentiary hearing was denied”.
Bryer adds that Hidaglo’s case would be better suited for certiorari with a similar record.
