Transgender marriage was recognized by the Arizona Court of Appeals, which granted Thomas Beatie, a transgender man, a divorce from his wife, reports USA Today.
Thomas Beatie became known as the “Pregnant Man” after undergoing gender-reassignment surgery, obtaining legal recognition as a male in Hawaii courts, getting married to a woman, and then giving birth to three children.
When the Beatie’s moved to Arizona and then petitioned for an uncontested divorce, a judge ruled that the marriage was between two females because Thomas Beatie had given birth, according to USA Today. Arizona does not recognize same-sex marriages; therefore the ruling prevented the divorce proceedings.

This month the appellate court ruled in the Beatie’s favor, allowing him and his wife to proceed with the divorce.
The court opinion that, “The question before this Court is not whether the State of Arizona allows same-sex marriage or divorce, but whether the laws of the State of Arizona allow a marriage, lawfully entered into in another state, between two persons the foreign state formally recognized at the time of the marriage as male and female, to be dissolved.”
