New Work Permit Violation Penalties for Foreigners in Thailand

 

The Thai Ministry of Labor has introduced new penalties for those who violate the laws and rules in regards to foreign nationals working in Thailand. New rules and revised old rules are as follows:

• If an employer employs a foreign national to work in a position specifically restricted to Thai nationals, said employer shall be fined between 400,000 and 800,000 baht per employed foreign national.
• If an employer allows a foreign national to work outside the employment description stated in the work permit, the employer will be fined up to 400,000 baht for each employed foreign national.
• If a foreign national works outside the employment description stated in the work permit, they may be imprisoned for more than 6 months and/or fined up to 100,000 baht.
• If a foreign national works without getting a work permit first or works in a position restricted to Thai nationals, they may face up to five years imprisonment and/or fined between 2,000-100,000 Baht.
• If a foreign national works on something which is deemed immediate and important and does so without acknowledgment of a Labor Ministry officer by receiving form WP-10, they may be fined up to 100,000 Baht.
• If an individual explicitly or implicitly advertises that they are able to bring a foreign national to work in Thailand without needing a work permit, they could be imprisoned for 3-10 years and/or fined 600,000-1,000,000 baht.
• If anyone is found as a foreign job placement agency without a proper license, they could be subject to possible imprisonment for 1-3 years and/or fines between 200,000-600,000 baht.
