UK Lady Sues Lawyers for Not Warning Her Divorce Would Terminate Marriage
Many people might think that divorce and the end of a marriage go hand in hand, but apparently not everyone is aware of this report The Independent.
Jane Mulcahy had argued that her lawyers should have made it clear that a divorce would cause her marriage to be terminated – something which she apparently wanted to avoid for religious reasons. Ms Mulchay appears to believe she should have been advised to enter into a judicial separation which would not have caused the final termination of her marriage.
In Thailand divorces the legal concept of an “annulment” is a legal proceeding that declares a marriage void, meaning that it never legally existed. In Thailand actions to declare a marriage “void” would normally need to be decided through a court action in the form of a complaint applied to the Thai Family Court. Thai Family law declares a marriage either “void” or “voidable”, where there are issues of insanity, if one of the parties was insane, if one of the parties was already married, and if the marriage was not formally registered.
Despite suing two different firms of solicitors, Ms Mulchay has been unsuccessful with her appeal. It is unclear at this stage whether she has been granted further leave to appeal.
